Terms of Service

These Terms of Service ("Terms") govern your use of the StackD Workforce Enterprise platform ("Platform") operated by StackD Workforce Enterprise, LLC, a Texas limited liability company.
1. Platform Purpose
StackD is a marketplace that connects independent contractor firms with operators seeking specialized workforce services in heavy industry. The Platform facilitates discovery, engagement, and payment processing while maintaining DOL 6-Factor compliance for independent contractor relationships.
2. Independent Contractor Status
All contractor firms and individuals using this Platform operate as independent contractors. The Platform does not create an employment relationship between any parties. Contractors:
- Control their own schedule, methods, and workflow
- Provide their own tools, equipment, and insurance
- Have the right to accept or decline any engagement
- May subcontract work at their discretion
- Bear their own profit and loss from engagements
- Exercise independent judgment and specialized skill
3. User Accounts
You are responsible for maintaining the security of your account credentials. You must provide accurate information during registration and keep it current. Each organization may have one account per entity.
4. Payments
Payments are processed through Stripe. The Platform charges a service fee on completed engagements. Payment terms, milestones, and deliverables are agreed between operators and contractors for each engagement. StackD is not a party to the service agreement between operators and contractors.
5. Prohibited Uses
You may not use the Platform to:
- Misrepresent credentials, certifications, or insurance coverage
- Circumvent Platform payment processing for engaged work
- Exercise employer-level control over contractor methods or schedule
- Violate applicable labor, safety, or environmental regulations
- Submit fraudulent bids or job postings
6. Limitation of Liability
StackD provides the Platform "as is" and makes no warranties regarding the quality of work performed by contractors or the reliability of operators. StackD is not liable for disputes between operators and contractors beyond facilitating communication.
7. Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Harris County, Texas.
